A Local Law to amend the New York city charter, in relation to publication of bylaws by borough boards, community boards, and advisory bodies
Be it enacted by the Council as follows:
Section 1. Subdivision b of section 85 of the New York city charter is amended by adding a new paragraph 3-a to read as follows:
(3-a) Publish such by-laws to its website, or to the website of the borough president, in a searchable, non-proprietary, and machine-readable format, and publish updated by-laws no later than two weeks after the date on which such board adopts revisions to such by-laws;
§ 2. Chapter 47 of the New York city charter is amended to add a new section 1069.2 to read as follows:
§ 1069.2. By-laws of advisory bodies. a. Definitions. As used in this section the following terms have the following meanings:
Advisory body. The term “advisory body” means an entity: (i) established by local law or executive order to advise, study, or report on a subject; (ii) the body of which includes at least one member of the public; (iii) which holds one or more public meetings; and (iv) that is neither a community board nor a borough board.
By-laws. The term “by-laws” means the code or codes of rules adopted for the regulation or management of the affairs of an advisory body regardless of the name or names by which such rules are designated.
b. Publication of by-laws. Any advisory body that adopts by-laws shall publish such by-laws to its website, or to the city’s website, in a searchable, non-proprietary, and machine-readable format. Any advisory body that updates its by-laws shall publish updated by-laws no later than 2 weeks after the date on which such advisory body adopts revisions to such by-laws. An advisory body that has completed its functions pursuant to local law or executive order shall no longer be required to post or update its by-laws pursuant to this paragraph.
§ 3. Subdivision d of section 2800 of the New York city charter is amended by adding a new paragraph 7-a to read as follows:
(7-a) Publish such by-laws on its website in a searchable, non-proprietary, and machine-readable format, and publish updated by-laws no later than 2 weeks after the date on which such board adopts revisions to such by-laws;
§ 4. This local law takes effect immediately.
