A Local Law to amend the administrative code of the city of New York, in relation to prohibiting the distribution of hypodermic syringes and needles by mobile syringe service programs in certain locations

 

Be it enacted by the Council as follows:

 

Section 1. Subdivision a of section 17-180.1 of the administrative code of the city of New York, is amended by adding new definitions of “adjacent to any school premises”; “mobile syringe service program”; “playground”; and “school premises” in alphabetical order to read as follows:

Adjacent to any school premises. The term “adjacent to any school premises” means any sidewalk that directly abuts a school premises.

Mobile syringe service program. The term “mobile syringe service program” means any person, organization, or entity authorized by the state department of health to distribute hypodermic syringes and needles and operating out of a van, bus, or automobile.

Playground. The term “playground” has the same meaning as set forth in section 17-1202.

School premises. The term “school premises” has the same meaning as set forth in section 17-702.

§ 2. Section 17-180.1 of the administrative code of the city of New York is amended by adding a new subdivision j to read as follows:

j. Prohibition on the distribution of hypodermic syringes and needles by mobile syringe service programs in certain locations. A mobile syringe service program shall not distribute hypodermic syringes and needles in the following locations in the city: within any playground; within 50 feet of a playground, where practicable; on any school premises, or adjacent to any school premises.

§ 2. This local law takes effect on the same day that a local law relating to the safe collection and disposal of needles and syringes, as proposed in introduction number 1169-A, takes effect.
