Summary: This bill would require the Commissioner of Consumer and Worker Protection to seek to coordinate with and request data from New York State to create an online dashboard, updated weekly, that displays rates of employee participation in the New York State Secure Choice Savings Program. The Commissioner of Consumer and Worker Protection would also be required to seek to coordinate with and request data from New York State to complete a study and annual report on the program and be required to conduct outreach and education on the program with a focus on community districts with the lowest rates of retirement saving. Finally, the Commissioner of Small Business Services would have to provide training and education to employers in navigating the program.

A Local Law to amend the administrative code of the city of New York, in relation to reporting on and assisting employers with the New York state secure choice savings program

 

Be it enacted by the Council as follows:

 

Section 1. Title 20 of the administrative code of the city of New York is amended by adding a new chapter 17 to read as follows:

CHAPTER 17

RETIREMENT OVERSIGHT

§ 20-1701 Definitions. As used in this chapter, the following terms have the following meanings:

Board. The term “board” has the same meaning as set forth in subdivision 1 of section 1300 of the general business law.

Dashboard. The term “dashboard” means a data visualization tool publicly available on the internet that includes current data from one or more sources.

Employee. The term “employee” has the same meaning as set forth in subdivision 3 of section 1300 of the general business law.

Employer. The term “employer” has the same meaning as set forth in subdivision 4 of section 1300 of the general business law.

State secure choice savings program. The term “state secure choice savings program” has the same meaning as set forth for the term “program” in subdivision 10 of section 1300 of the general business law.

§ 20-1702 Tracking and reporting. a. Dashboard. 1. The commissioner shall seek to coordinate with and request data from the board and the New York state department of taxation and finance to create a dashboard on the department’s website displaying participation and opt-out rates of city resident employees in the state secure choice savings program. Such information shall be disaggregated by industry sector and community district.

2. No later than 1 year after the effective date of the local law that added this section, the commissioner shall make the dashboard available for public viewing, to the extent that the information required under paragraph 1 of this subdivision is available to the commissioner. The commissioner shall update such dashboard no less than once monthly.

b. Study and report. 1. The commissioner shall seek to coordinate with and request data from the board and the New York state department of taxation and finance to complete a study on the state secure choice savings program. The study shall include, but need not be limited to:

(a) Analysis of the rates of city resident employees participating in and opting out of the state secure choice savings program;

(b) Analysis of the changes over time in the rates analyzed under subparagraph (a) of this paragraph;

(c) Analysis of employer compliance with the requirements of such program;

(d) Identification of obstacles to broader participation in such program;

(e) Identification of recommendations for broader participation in such program; and

(f) Analysis of the impact of such program on the long-term financial security of city resident employees.

2. No later than 1 year after the effective date of the local law that added this section and annually thereafter, to the extent that the information described in paragraph 1 of this subdivision is available to the commissioner, the commissioner shall submit a report on the findings of such study to the mayor and the speaker of the council and post such report on the department’s website. In the report, the commissioner shall disaggregate the information required under subparagraphs (a) and (b) of paragraph 1 of this subdivision by industry sector and community district, to the extent possible.

§ 20-1703 Outreach and education. a. Campaign. The commissioner shall establish and conduct an outreach and education campaign to (i) increase awareness of the state secure choice savings program; and (ii) inform employees how to enroll in and opt out of such program and how to adjust contributions to a retirement plan under such program following enrollment. The commissioner shall make any educational materials distributed pursuant to this subdivision available in plain language and in English and the designated citywide languages, as such term is defined in section 23-1101. The commissioner shall also make such materials available on the department’s website.

b. Targeted outreach. The commissioner, in coordination with the commissioner of small business services and in consultation or partnership to the extent feasible with community-based organizations deemed relevant by the commissioner, shall conduct outreach designed to increase participation in the state secure choice savings program. The commissioner shall conduct such outreach in up to 20 of the community districts that are identified under subdivision c of this section as the community districts with the lowest percentage of employees participating in retirement plans. Such outreach shall include but need not be limited to holding informational workshops or other public events.

c. Participation rates. The commissioner shall identify the percentage of employees participating in retirement plans, as defined in section 20-1401, in each community district.

§ 2. Subdivision a of section 22-1004 of the administrative code of the city of New York, as added by local law number 156 for the year 2019 and redesignated by local law number 90 for the year 2020, is amended to read as follows:

a. The department shall provide business services including training and education to small businesses regarding the following subjects:

1. Business operations, including the establishment and use of technological or other systems to deliver goods or services to customers efficiently, reduce costs, and maximize profits;

2. Marketing, including identifying market opportunities, preparing and executing marketing plans, developing pricing strategies, locating contract opportunities, negotiating contracts, utilizing public relations and advertising techniques, engaging in e-commerce, and retail merchandizing;

3. Compliance obligations, including education about regulatory requirements and assistance in understanding laws and rules applicable to small businesses; [and]

4. Determining employer eligibility and certifying employer exemptions under the New York state secure choice savings program set forth in article 43 of the general business law, and implementing payroll systems for employee contributions under such program; and

5. Such other training and education as the commissioner may deem appropriate.

§ 3. This local law takes effect immediately.
