Title: A Local Law to amend the administrative code of the city of New York, in relation to notice requirements for food service establishment inspections

Summary: This bill would require the New York City (City) Department of Health and Mental Hygiene (DOHMH) to provide at least 2 notices of inspection to food service establishments prior to a sanitary inspection conducted by a DOHMH food service establishment inspector. The first notice would be issued between 1 to 5 months prior to an inspection, and a second notice would be issued between 3 to 6 weeks prior to an inspection. The bill requires such notices to include information and resources for food service establishments to prepare for inspections, as well as information referring such establishments businesses to no-cost compliance education in advance of inspections to assist such establishments in understanding City rules regarding sanitary inspections and food service establishment sanitary regulations.

A Local Law to amend the administrative code of the city of New York, in relation to notice requirements for food service establishment inspections

 

Be it enacted by the Council as follows:

 

Section 1. Chapter 15 of title 17 of the administrative code of the city of New York is amended by adding a new section 17-1519 to read as follows:

§ 17-1519 Notice of inspection. a. Prior to any sanitary inspection of a food service establishment, the department shall provide, at minimum, 2 notices of inspection to such food service establishment. The first such notice shall be sent to the physical and email address provided by a food service establishment between 1 month and 5 months prior to any such inspection. The second such notice shall be sent to the physical and email address provided by a food service establishment between 3 weeks and 6 weeks prior to any such inspection.

b. The notices of inspection provided pursuant to subdivision a of this section shall include information and resources for food service establishments to prepare for such inspection. Such information shall include a checklist of conditions that a food service establishment inspector may inspect for during such inspection, as well as information for food service establishments to obtain no-cost inspection compliance education in advance of an inspection.

§ 2.  This local law takes effect 90 days after it becomes law.
