Summary: The Public Oversight of Surveillance Technology (POST) Act was enacted by City Council in 2020 and requires the New York City Police Department (NYPD) to evaluate and report on surveillance technologies used by the Department. This legislation would add new provisions to the law which would require that the NYPD, upon request, provide the Department of Investigation (DOI) with an itemized list of all surveillance technologies currently used by the Department, and provide information on all data access and retention policies for data collected by such technologies. In addition, the legislation requires that the NYPD provide DOI with semiannual updates on all newly acquired or discontinued surveillance technologies and updates to any data access and retention policies established in recently executed contracts for surveillance technologies.

A Local Law to amend the administrative code of the city of New York, in relation to the department of investigation’s oversight of the police department use of surveillance technology

 

Be it enacted by the Council as follows:

Section 1. Section 14-188 of the administrative code of the city of New York is amended by adding new subdivisions j and k to read as follows:

j. Upon request, the department shall provide the commissioner of investigation with prompt access to the following information:

1. an itemized list of all surveillance technologies used by the department, including specifications of the functionality of each such technology, the types of data collected by each such technology, and which department unit maintains control of information collected by each such technology; and

2. any access and retention policies for data collected by surveillance technologies used by the department, including any access and retention policies included in contracts with entities from which the department procures such surveillance technologies.

k. No later than July 1, 2025, and semiannually thereafter, the department shall provide the commissioner of investigation with a list of all surveillance technologies that were acquired by the department, or which the department discontinued using, during the prior six months, and all access and retention policies for data collected by such surveillance technologies included in any executed contracts with entities from which the department procured such surveillance technology during the prior six months.

§ 2. This local law takes effect immediately.
