A Local Law to amend the administrative code of the city of New York in relation to requiring prompt repair of street furniture
Be it enacted by the Council as follows:
Section 1. Subchapter one of chapter one of title 19 of the administrative code of the city of New York is amended by adding a new section 19-128.2 to read as follows:
§ 19-128.2 Damaged or missing street furniture. a. Definitions. For the purposes of this section, the term “street furniture” means any object or piece of equipment installed on public streets for public use, but not including priority regulatory signs and traffic control signals as defined in section 19-128 and newsracks as defined in section 19-128.1.
b. The commissioner shall maintain a log of notices regarding street furniture under the responsibility of the department to maintain that is missing or damaged to the extent that the street furniture is not operational, visible, or legible. The log shall include the date on which each notice was received and the date on which the street furniture was repaired or replaced, or if the department determines that repair or replacement is not warranted, the date on which the department determined that repair or replacement was not warranted and the reason for that determination.
c. On an annual basis, the commissioner shall deliver to the speaker of the council and post on the department's website a report on the information compiled in accordance with subdivision b of this section.
d. Within 3 months of receiving notice that any street furniture under its responsibility to maintain is missing or damaged to the extent that the street furniture is not operational, visible, or legible, the commissioner shall repair or replace that street furniture or determine that repair or replacement is not warranted.
e. Any contract entered into or renewed by or through an agency that authorizes an entity other than the department to repair or replace street furniture shall contain a provision ensuring all work to repair or replace that street furniture be finalized within 3 months from the date when the entity receives notice that the street furniture is missing or damaged to the extent that the street furniture is not operational, visible, or legible.
§ 2. This local law takes effect immediately.
