Summary: This bill would require the Commissioner of Health and Mental Hygiene to, no later than one year after the effective date of the proposed legislation, establish an ongoing public outreach and education campaign regarding the use and availability of fentanyl test strips. The campaign would focus on the creation and distribution of informational materials that inform New Yorkers about organizations through which and locations where these strips are available, educate New Yorkers on how to use these strips effectively, and encourage New Yorkers to use these strips. The Commissioner would also be required to post these materials online and make all of the materials available in English and in each of the designated citywide languages.

A Local Law to amend the administrative code of the city of New York, in relation to establishing a public outreach and education campaign regarding the availability and use of fentanyl test strips

 

Be it enacted by the Council as follows:

 

Section 1. Chapter 1 of title 17 of the administrative code of the city of New York is amended by adding a new section 17-199.26 to read as follows:

§ 17-199.26 Fentanyl test strip outreach and education. a. Definitions. For purposes of this section, the term “fentanyl test strip” means a drug testing technology that can detect the presence of fentanyl in drug samples prior to use.

b. The commissioner shall establish an ongoing outreach and education campaign regarding the availability and use of fentanyl test strips. Through such campaign, the commissioner shall, at a minimum, create and distribute to the general public in hard copy and electronically informational materials that:

1. Provide information about organizations through which and locations in the city where fentanyl test strips are available;

2. Provide education on how to use fentanyl test strips effectively; and

3. Encourage the use of fentanyl test strips.

c. The commissioner shall also post the informational materials created through the campaign established under subdivision b of this section on the department’s website.

d. The commissioner shall make all informational materials created through the campaign established under subdivision b of this section available in English and in each of the designated citywide languages, as such term is defined in section 23-1101.

e. The commissioner shall begin implementation of the campaign established under subdivision b of this section no later than 1 year after the effective date of the local law that added this section.

§ 2. This local law takes effect immediately.JL
