Summary: This bill would require the taxi and limousine commission, in collaboration with the police department and department of transportation, to develop and maintain a checklist of applicable rules and regulations that relate to unlicensed commuter vans. This checklist would be utilized in the training of officers authorized to enforce the commission’s rules, as well as during enforcement actions against unlicensed commuter vans. In addition, the taxi and limousine commission would be required to conduct no fewer than six operations each quarter to inspect routes used by unlicensed commuter vans in order to identify potential violations of the commission’s rules and regulations.

A Local Law to amend the administrative code of the city of New York, in relation to a checklist for enforcing violations against unlicensed commuter vans

 

 Be it enacted by the Council as follows:

 

Section 1. Chapter 5 of title 19 of the administrative code of the city of New York is amended by adding a new section 19-504.5 to read as follows:

§ 19-504.5 Enforcement against unlicensed commuter vans and unauthorized commuter van services. a. The commission, in consultation with the police department and the department of transportation, shall develop and maintain a checklist of state and local laws, rules, and regulations relating to commuter vans that a person operating a vehicle as a commuter van without a commuter van license may violate. The commission shall include such checklist and instructions on how to utilize such checklist in the training of any officer authorized to enforce the commission’s rules and regulations governing commuter vans.  

b. To the extent practicable, any officer authorized to enforce the commission’s rules and regulations governing commuter vans, upon stopping and identifying a vehicle operating as a commuter van without a commuter van license, shall utilize the checklist developed and maintained pursuant to subdivision a of this section to assist such officer in enforcing laws, rules, and regulations relating to commuter vans that govern the operation of such vehicle.

c. Each quarter, the commission shall conduct no fewer than 6 operations to inspect a route that, as determined by the commission, vehicles operating as commuter vans without a commuter van license use, to identify potential violations of laws, rules, and regulations relating to commuter vans or vehicles operating as commuter vans without a commuter van license.

§ 2. This local law takes effect 120 days after it becomes law.
