Title: A Local Law to amend the administrative code of the City of New York, in relation to community impact statements for transient hotels

Summary: This bill would require a community impact statement to be included in construction documents for the creation of, or conversion to, a transient hotel. The community impact statement would be required to evaluate the impact of the proposed transient hotel on nearby emergency services, utilities, and traffic, as well as the fit of the proposed transient hotel with the surrounding area. The community impact statement would be made publicly available and shared with the relevant Borough President, Council Member, and community board before the Department of Buildings approves construction documents and grants work permits for the creation of or alteration to a transient hotel.

A Local Law to amend the administrative code of the City of New York, in relation to community impact statements for transient hotels

 

Be it enacted by the Council as follows:

 

Section 1. Section 28-103.25 of the administrative code of the city of New York, as added by local law number 45 for the year 2015, is amended to read as follows:

§ 28-103.25 Hotel development plans. [Where] No later than 15 business days after the department receives applications for new construction of or conversions to transient hotels, as defined in the zoning resolution, the department shall provide [written notice, or] notice by electronic mail, or by mail where the electronic mail address of the intended recipient is not available to the department, of the proposed construction or conversion, including a copy of the community impact statement submitted to the department in accordance with the requirements of article 121 of this chapter, to:

1. The borough president of the borough in which such proposed construction is located;

2. The council member in whose district such proposed construction is located;

3. The community board of the community district in which such proposed construction is located; and

4. If such proposed construction involves land within two or more community districts in a borough, the borough board.

§ 2. Article 104 of chapter 1 of title 28 of the administrative code of the city of New York is amended by adding a new section 28-104.7.19 to read as follows:

§ 28-104.7.19 Community impact statements for transient hotels. The title sheet of construction documents shall contain a statement requiring a community impact statement be submitted in accordance with the requirements of article 121 of this chapter prior to the issuance of a permit for the new construction of or conversion to a transient hotel, as defined in the zoning resolution.

§ 3. Chapter 1 of title 28 of the administrative code of the city of New York is amended by adding a new article 121 to read as follows:

ARTICLE 121
COMMUNITY IMPACT STATEMENT

§ 28-121.1 Submission of community impact statement. A community impact statement shall be prepared and submitted for the new construction of or conversion to a transient hotel, as defined in the zoning resolution. No permit shall be issued for work that requires a community impact statement under this article unless such statement is deemed complete by the department. The department may consult with the department of transportation or any other relevant agency before deeming a community impact statement complete. A community impact statement shall be prepared by or under the supervision of a registered design professional and signed by the owner of the building and the permit applicant. Such statement shall be filed with the department pursuant to section 28-104.7.19 and shall include the number of units located in the proposed transient hotel, the size of the building, and an analysis of the impact of the proposed transient hotel on the nearby community. Such analysis shall, at a minimum, include the following:

1. Emergency services. A projection of the impact of the proposed transient hotel on the operations and availability of nearby emergency services, including the capacity of hospitals and the response time of the police department and the fire department.

2. Utilities. A projection of the impact of the proposed transient hotel on the local availability of utilities, including electricity, sewage, and water.

3. Traffic. A projection of the impact of the proposed transient hotel on traffic and parking in the surrounding area.

4. Need. A demonstration of the need for a transient hotel at the proposed location.

5. Fit. An evaluation of land use in the surrounding area, including the height, bulk, and nature of nearby residential and commercial buildings, and the suitability of the proposed transient hotel for such area.

§ 28-121.2 Public availability of community impact statement. No later than 15 business days prior to the issuance of a permit for work requiring a community impact statement under this article, the department shall make such community impact statement available on the department’s website.

 § 4. This local law takes effect 120 days after it becomes law.
