Summary: This bill would require the New York City Human Resources Administration (HRA) to issue duplicate transit benefit cards under the Fair Fares NYC program where a participant’s card was damaged, destroyed, stolen, or lost. HRA would be required to provide one replacement card free of charge, but would charge a fee of $15 for any subsequent replacement cards. The bill would prohibit HRA from limiting the number of requests of a duplicate card a participant could make, provided they pay the $15 fee.

A Local Law to amend the administrative code of the city of New York, in relation to the department of social services issuing replacement transit benefit cards

 

Be it enacted by the Council as follows:

 

Section 1. Chapter 1 of title 21 of the administrative code of the city of New York is amended by adding a new section 21-154 to read as follows:

§ 21-154 Duplicate transit benefit cards. a. Definitions. For purposes of this section, the following terms have the following meanings:

Participant. The term “participant” means an individual enrolled in a reduced fare program.

Reduced fare program. The term “reduced fare program” means a program established pursuant to chapter 12 of title 68 of the rules of the city of New York, or a successor provision, to provide a discount on designated city transit options, including subway or bus service.

Transit benefit card. The term “transit benefit card” means a card, pass, or other medium that allows participants to access designated city transit options and is issued as part of a reduced fare program.

b. Whenever any transit benefit card issued by the department is damaged, destroyed, stolen, or lost, the commissioner shall issue a duplicate transit benefit card to the participant. No fee shall be charged to a participant for issuance of an initial card or for a first replacement card, but a fee of $15 shall be charged for each subsequent replacement card issued to the same participant. The commissioner shall not limit the number of requests a participant may make for a duplicate transit benefit card in accordance with this section.

c. This section does not limit the commissioner’s authority to require a participant to surrender a damaged card or to report a card as destroyed, stolen, or lost, as applicable, before issuing a duplicate transit benefit card.

§ 2. This local law takes effect immediately.
