Summary: This bill would require the establishment of nightlife districts based on several criteria. The Department of Sanitation (DSNY) would be required to increase street sweeping and litter basket services by 1 day on the weekends in any such nightlife district at the request of the relevant community board. This bill would also permit DSNY to resume its original street sweeping and litter basket schedule if, for 30 days, there has been a reduction in street cleanliness-related 311 service requests in such nightlife district.

A Local Law to amend the administrative code of the city of New York, in relation to enhanced street cleaning and litter basket services in nightlife districts

 

Be it enacted by the Council as follows:

 

Section 1. Chapter 1 of title 16 of the administrative code of the city of New York is amended by adding a new section 16-111.3 to read as follows:

§ 16-111.3 Street cleaning and litter basket services in nightlife districts.

a. Definitions. As used in this section, the following terms have the following meanings:

Nightlife district. The term “nightlife district” means a sanitation section identified by the department pursuant to subdivision b of this section.

Nightlife establishment. The term “nightlife establishment” has the same meaning as set forth in section 20-d of the charter.

Sanitation section. The term “sanitation section” means a geographically contiguous subdivision of a sanitation district, as determined by the department, provided that no individual subdivision shall represent more than one-third of such sanitation district.

b. The commissioner, in consultation with the office of nightlife established pursuant to section 20-d of the charter and the department of transportation, shall designate sanitation sections as nightlife districts based on the following criteria:

1. High levels of pedestrian use and demand;

2. The zip code tabulation area or areas within such sanitation section has a density of nightlife establishments that is higher than the average density of such establishments in any of the city’s zip code tabulation areas; and

3. There is a high number of 311 service complaints related to inadequate street sweeping, trash or debris in the street, a dirty gutter, or an overflowing litter basket.

c. A community board may submit a written request to the commissioner for supplemental street cleaning and litter basket services in a nightlife district fully or partially located in such community board district. The department shall add 1 additional day of street cleaning and litter basket services each week in such nightlife district, to occur between 1 p.m. on Saturday and 6 a.m. on Monday.

d. In any nightlife district where, pursuant to subdivision c of this section, the department has increased street cleaning and litter basket services, the department shall have the option to resume the street cleaning and litter basket schedule that was in effect at the time of such community board’s request if the number of 311 service complaints related to inadequate street sweeping, trash or debris in the street, a dirty gutter, or an overflowing litter basket in such nightlife district has been lower than the number at the time the community board submitted such request for 30 consecutive days.

§ 2. This local law takes effect 180 days after it becomes law.
