Hotel operators of small hotels, which would include hotels with less than 100 rooms, would be exempt from the direct employment requirement. Owners without central cooling would have to install cooling systems within residential units. Leases must contain notice of the cooling requirements. All of the abovementioned requirements would be imposed four years after the bill’s effective date. Owners claiming undue hardship would be able to apply for additional time for compliance with the cooling requirements. Owners would have to carry out pre- and post-enforcement reporting to the city concerning compliance with the cooling requirements. The bill would impose separate civil penalties for violation of the cooling and notice requirements. The study must consider the ways in which sequestration can be done relative to whether the possible emissions source is a solid, liquid, or a gas, whether there is the capacity to store the emissions source, the challenges therein, and the cost of sequestration. The legislation would grant DOHMH, in conjunction with OEM, the discretion of designating the number and location of cooling centers, but would require that there be no fewer than the median number of cooling centers operated during heat-related emergencies in 2017. In designating such centers, the agencies would have to take into account where vulnerable populations reside and where such populations would be likely to use centers. In addition, DOHMH would be required to post information about the cooling center program on its website and would also have to conduct a public education campaign to increase awareness of cooling centers and the risks associated with heat-related emergencies and poor air quality.
