A Local Law to amend the administrative code of the city of New York, in relation to provision of portable self-contained tabletop appliances

 

Be it enacted by the Council as follows:

 

Section 1. Section 27-2005 of article 1 of subchapter 2 of chapter 2 of title 27 of the administrative code of the city of New York is amended by adding a new paragraph g to read as follows:

g. 1. An owner of a multiple dwelling and an owner of a dwelling unit in a multiple dwelling other than a dwelling unit owned as a condominium or a cooperative and used as the primary residence of such owner, shall provide the occupant of such unit with a portable self-contained tabletop appliance for food preparation, where such unit (i) has a gas stove which is inoperable due to lack of gas supply to such unit, and (ii) such outage has lasted longer than two hours.

2. Failure to provide such appliance for food preparation within twenty-four hours of such outage shall subject the owner to a penalty of no less than $500 for each day that such unit was not provided with such appliance, not to exceed $5,000.

                     § 2. This local law takes effect 120 days after enactment, except that the commissioner of the department of housing preservation and development may take such measures as are necessary for the implementation of this local law, including the promulgation of rules, before such date.
