Title: A Local Law to amend the administrative code of the city of New York, in relation to guidance relating to the child care program permitting process

Summary: This bill would require the New York City (“City”) Department of Health and Mental Hygiene (DOHMH) to provide guidance to prospective child care programs applying for a permit pursuant to Article 47 of the Health Code. The required guidance would include a visual representation of the permitting process and include information relating to any required license, approval, or permit from DOHMH or another agency, as well as the order in which licenses, approvals, or permits must be obtained. The bill would also require any guidance or updates to such guidance to be posted on relevant City websites in the designated citywide languages and submitted to the Mayor and the Council.

A Local Law to amend the administrative code of the city of New York, in relation to guidance relating to the child care program permitting process

 

Be it enacted by the Council as follows:

 

Section 1. Chapter 13 of title 17 of the administrative code of the city of New York is amended by adding a new section 17-1312 to read as follows:

§ 17-1312 Guidance relating to the child care program permitting process. a. The department shall, in coordination with any other agency as it deems necessary, provide guidance to an applicant for a permit for a child care program pursuant to article 47 of the health code on the requirements for obtaining such permit. Such guidance shall include a visual representation of the process and include the following information: any required license, approval, or permit from the department or any other agency and the order in which each such license, approval, or permit must be obtained. The inadvertent failure to include any such license, approval, or permit in guidance provided pursuant to this subdivision shall not invalidate the requirement to obtain such license, approval, or permit.

b. The commissioner shall post on the department’s website, and update as necessary, the guidance required pursuant to subdivision a of this section and, as relevant, include a description of any such update or other change made to such guidance. Such guidance and updates shall be provided in the designated citywide languages defined in section 23-1101 and also be posted on any other city website where the department makes permitting information available. The department shall submit such guidance and any subsequent updates to the mayor and the speaker of the council.

§ 2. This local law takes effect 90 days after it becomes law.
