A Local Law to amend the administrative code of the city of New York, in relation to requiring the reapplication of food protection course certification every 5 years

 

Be it enacted by the Council as follows:

 

Section 1. Section 17-1501 of the administrative code of the city of New York is amended by adding a new definition of “food protection course certification” in alphabetical order to read as follows:

Food protection course certification. The term “food protection course certification” means a certificate or certification, issued by the department upon (i) a person’s completion of a course of instruction covering food protection principles, including safe food handling and storage, time and temperature control for safety, prevention of cross-contamination, personal hygiene practices, allergen awareness, and sanitation of food-contact surfaces and equipment, and any additional information the department deems relevant, as provided in section 21-02 of title 24 of the rules of the city of New York, regarding food protection courses and fees, or a successor provision; and in accordance with section 81.15 of the New York city health code regarding food protection courses, or a successor provision; and (ii) passage of a written examination administered by or on behalf of the department demonstrating competency in such principles, as provided in section 21-02 of title 24 of the rules of the city of New York, regarding food protection courses and fees, or a successor provision; and in accordance with section 81.15 of the New York city health code regarding food protection courses, or a successor provision.

§ 2. Subdivision a of Section 17-1509 of the administrative code of the city of New York, as added by local law number 80 for the year 2021, is amended to read as follows:

a. A person who is charged with the management or supervision of the operations of a food service establishment shall [comply with the requirements set forth in subdivision (a) of section 81.15 of the health code of the city of New York regarding a food protection course and certification.] obtain a food protection course certification. Such certification shall be valid for 5 years from the date of issuance. A person holding such certification shall reapply for and obtain a new certification no less frequently than once every 5 years.

§ 3. This local law takes effect 120 days after it becomes law.
