THE COUNCIL OF THE CITY OF NEW YORK RESOLUTION NO. 2173 Title Resolution approving the decision of the City Planning Commission on ULURP No. C 010126 PCM (L.U. No. 1250), site selection and acquisition of property located at 35 East 4th Street, Manhattan, for use as a water tunnel shaft. Body By Council Members Eisland and Sabini WHEREAS, the City Planning Commission filed with the Council on November 14, 2001 its decision dated November 7, 2001 (the "Decision") on the application submitted pursuant to Section 197-c of the New York City Charter by the Department of Environmental Protection and the Department of Citywide Administrative Services for site selection and acquisition of property located at 35 East 4th Street (Block 544/Lot 68), Borough of Manhattan (the "Site"), for use as a water tunnel shaft (ULURP No. C 010126 PCM) (the "Application"); WHEREAS, the Decision is subject to review and action by the Council pursuant to Section 197-d(b)(3) of the City Charter; WHEREAS, upon due notice, the Council held a public hearing on the Decision and Application on December 18, 2001; WHEREAS, the Council has considered the relevant environmental issues and the Negative Declaration issued on April 3, 2001 (CEQR No. 00DEP074M); and WHEREAS, the Council has considered the land use implications and other policy issues relating to the Decision and Application; RESOLVED: The Council finds that the action described herein will have no significant effect on the environment.
