A Local Law in relation to requiring the department of sanitation to conduct a study regarding the feasibility of accommodations for religious practices that conflict with set-out times for solid waste and recyclable materials
Be it enacted by the Council as follows:
Section 1. a. Definitions. For purposes of this local law, the following terms have the following meanings:
City. The term “city” means the city of New York.
Commissioner. The term “commissioner” means the commissioner of sanitation.
Department. The term “department” means the department of sanitation.
b. Study. The commissioner shall conduct a study regarding the feasibility of accommodations to address conflicts between religious practices and set-out times for solid waste and recyclable material. Such study shall be completed within 6 months of the effective date of this local law and include:
1. An analysis of the extent to which existing set-out times for solid waste and recyclable material may conflict with the practices of the city’s religious communities, including sabbath observance, holidays, and other practices that may affect compliance with set-out times, and an estimate of the number of people affected by such conflicts;
2. Proposals for modifications to the current collection system or other accommodations that could reduce the conflicts identified pursuant to paragraph 1;
3. An estimate of the financial cost and assessment of the feasibility of the proposals developed pursuant to paragraph 2; and
4. Any other considerations the commissioner deems relevant.
c. Report. No later than 1 year after the effective date of this local law, the commissioner shall submit to the mayor and speaker of the council, and post on the department’s website, a report on the findings of the study required under subdivision b of this section.
§ 2. This local law takes effect immediately.
