Resolution calling upon the New York State Legislature to pass, and the Governor to sign, A.9033-A/S.8960-A, in relation to enacting the “Extreme Weather Tenant Protection Act”

                     Whereas, In June 2025, the New York City (“NYC” or “City”) Department of Health and  Mental Hygiene (“DOHMH”) release a report examining heat-related mortality between 2018 and 2022; and

Whereas, The DOHMH report found that heat-related deaths in the City had risen over the decade preceding the report, more than 500 New Yorkers die prematurely each year because of heat, heat accounts for an average of 3 percent of all deaths in the City from May through September, and Black New Yorkers are twice as likely as white New Yorkers to die from heat stress; and

                     Whereas, DOHMH warns that inadequate or unstable housing during extreme heat increases the risk of heat exacerbated death; and

                     Whereas, DOHMH also warns that exposure during extreme cold poses a direct risk to life and health; and

Whereas, According to a Legal Services NYC report entitled “The Deadly Impact of Evictions During Extreme Heat” (“LSNYC Report”), the City and New York State (“NYS” or “State”) previously paused evictions following Hurricane Sandy in November 2012, and the NYC Department of Investigations instructed the City Marshals Bureau to suspend evictions during the heat waves of late June and late July 2025; and

Whereas, According to the LSNYC Report, Sonoma County, California adopted an ordinance in September 2024 prohibiting evictions during a state of emergency, and Maryland recently passed a law pausing evictions during extreme weather, which included National Weather Service excessive heat warnings and extreme cold events; and

Whereas, The LSNYC Report notes that during the June 2025 East Coast heat wave, the Baltimore City Sherrif’s Office suspended evictions from June 22 through June 26, while NYC did not suspend evictions, resulting in 60 households being evicted on June 23, when the actual temperature reached 94 degrees Fahrenheit and the heat index reached 104 degrees Fahrenheit; and

Whereas, A.9033-A, introduced by Assembly Member Yudelka Tapia and pending in the New York State Assembly, and companion bill, S.8960-A, introduced by State Senator Jamaal Bailey and pending in the New York State Senate, would pause residential evictions during extreme weather conditions, including any period for which the National Weather Service has issued an official warning or advisory for excessive  heat or excessive cold, or a state of emergency declared by the State Governor for a severe weather event; and

Whereas, The pause would include the 72 hours following such periods of extreme weather conditions; and

Whereas, A.9033-A/S.8960-A would prohibit courts from issuing or executing eviction warrants and prevent sheriffs and marshals from removing tenants; and

Whereas, A.9033-A/S.8960-A would allow such eviction proceedings to resume after the 72-hour period following the extreme weather condition; and

Whereas, A.9033-A/S.8960-A would prevent unnecessary illness and death and reduce strain on the City’s emergency services and shelter system; and

Whereas, Evicting New Yorkers in dangerous heat or cold is inhumane; now therefore, be it

Resolved, that the Council of the City of New York calls upon the New York State Legislature to pass, and the Governor to sign, A.9033-A/S.8960-A, in relation to enacting the “Extreme Weather Tenant Protection Act.”
