Summary: This bill would require the City Chief Procurement Officer (CCPO), in consultation with the Corporation Counsel, to develop and implement uniform contract and invoice templates to be used by all city contracting agencies. Contracting agencies would be able to modify templates for specific contracts with approval from the CCPO.

A Local Law to amend the administrative code of the city of New York, in relation to creating uniform contract and invoice templates for all city agencies.

 

Be it enacted by the Council as follows:

     

Section 1. Chapter 1 of title 6 of the administrative code of the city of New York is amended by adding a new section 6-149 to read as follows:

§ 6-149 Uniform contract and invoice process.

a. Definitions. For purposes of this section, the term “contractor" means any person that enters into a contract with an agency.

b. The city chief procurement officer, in consultation with the corporation counsel, shall develop a uniform contract template to be used by all agencies when entering into contracts with contractors. Such template shall include, but not be limited to: terms and conditions applicable to all city contracts; payment schedules; and provisions for contract modification or termination.

c. The city chief procurement officer, in consultation with the corporation counsel, shall develop a uniform invoice template to be used by all contractors when submitting invoices to city agencies. Such template shall include, but not be limited to: the contractor's name, address, and tax identification number; city agency name and department; total invoice amount; a description of goods or services provided; contract number and purchase order number, if applicable; and payment terms.

d. Within one year of the effective date of this section, the city chief procurement officer shall publish the uniform contract template and uniform invoice template on the website of the city of New York.

e. All city contracting agencies shall implement the use of the uniform contract template and uniform invoice template for all new contracts and contract renewals within 90 days of the templates being published by the city chief procurement officer. Agencies may make modifications to provisions of the uniform contract template for specific contracts with approval from the city chief procurement officer.

f. The city chief procurement officer shall establish a system to monitor agency compliance with the use of the uniform contract template and uniform invoice template and shall report annually to the mayor and the speaker of the council on agency compliance with this section.

§ 2. This local law takes effect 120 days after enactment.
