A Local Law to amend the administrative code of the city of New York, in relation to establishing a pilot program for location-specific vending licenses for Fordham Road in the borough of the Bronx
Be it enacted by the Council as follows:
Section 1. Subdivision g of section 20-465 of the administrative code of the city of New York is amended by adding a new paragraph (6) to read as follows:
(6) No general vendor shall vend on Fordham Road between Grand Concourse and Webster Avenue without having first obtained a license in accordance with section 20-465.3.
§ 2 Subchapter 27 of chapter 2 of title 20 of the administrative code of the city of New York is amended by adding a new section 20-465.3 to read as follows:
20-465.3 Fordham road general vending licenses. a. Definitions. For purposes of this section, the following terms have the following meanings:
Business improvement district. The term “business improvement district” means a district as defined in section 980 of the general municipal law.
Fordham Road. The term “Fordham Road” means the area of Fordham Road in the borough of the Bronx between Grand Concourse and Webster Avenue.
Local development corporation. The term “local development corporation” means a local development corporation established under section 1411 of the not-for-profit corporation law.
b. Report. Within 180 days after the effective date of this local law, the commissioner shall submit to the speaker of the council and to the mayor and publish on the department’s website a report regarding general vendors operating on Fordham Road. Prior to the completion of the report, the commissioner shall provide notice to any affected business improvement district, local development corporation, and community board and provide an opportunity to submit comments to the department regarding any conclusions or recommendations of the report. Such report shall include the following information:
1. The number of general vendors who operate in accordance with section 20-453 on Fordham Road, observed over a period of not less than 30 days;
2. The number of individuals who vend without a valid license on Fordham Road, observed over a period of not less than 30 days; and
3. An evaluation of current placement practices of vendors on Fordham Road and any recommendations for changes to rules to improve street congestion and business activity.
c. Licenses. Upon the furnishing of information and an application in such form and detail as the commissioner may prescribe and upon the payment of a fee of 10 dollars, the commissioner shall issue licenses and renewals thereof for individuals to act as general vendors on Fordham Road. The commissioner shall make available for application at least 100 such licenses. If, following the publication of the report pursuant to subdivision b of this section, the commissioner determines that more such licenses are necessary to meet the needs of vendors in the area, the commissioner shall make additional such licenses available.
d. Restrictions. The licenses issued pursuant to this section are subject to the following:
1. Such licenses do not count toward the maximum number of general vendor licenses permitted pursuant to section 20-459.
2. Such licenses shall be valid for no longer than 5 years after the date of the local law that added this section.
3. No such license shall permit an individual to vend on any street other than Fordham Road or on any other public space.
§ 3. This local law takes effect immediately, except that subdivisions c and d of section 20-465.3 of the administrative code of the city of New York, as added by section two of this local law, take effect 180 days after it becomes law. This local law is deemed repealed 5 years after it becomes law.
