A Local Law to amend the administrative code of the city of New York, in relation to the sale and use of gasoline-powered leaf blowers and lawn mowers
Be it enacted by the Council as follows:
Section 1. Chapter 4 of title 20 of the administrative code of the city of New York is amended by adding a new subchapter 16 to read as follows:
SUBCHAPTER 16
LAWN CARE DEVICES
§ 20-699.26 Gasoline-powered leaf blowers and lawn mowers. a. Definitions. For purpose of this section, the term “gasoline” means any fuel sold for use in internal combustion engines, and commonly or commercially known or offered as gasoline.
b. No person shall distribute, sell, or offer for sale a gasoline-powered leaf blower or gasoline-powered lawn mower after December 31, 2025.
§ 20-699.27 Penalty. a. A person who violates any provision of this subchapter shall be subject to a civil penalty of not less than $250 nor more than $1,000 for each violation.
b. Civil penalties under this section may be recovered by the department in an action in any court of appropriate jurisdiction or in a proceeding before the environmental control board. Such board shall have the power to impose civil penalties provided for in this section.
§ 2. Subchapter 7 of chapter 1 of title 24 of the administrative code of the city of New York is amended by adding a new section 24-157 to read as follows:
§ 24-157 Gasoline-powered lawn care devices prohibited. No person shall operate a gasoline-powered leaf blower or gasoline-powered lawn mower after December 31, 2026.
§ 3. The table of civil penalties in subparagraph (i) of paragraph (3) of subdivision (a) of section 24-178 of the administrative code of the city of New York is amended by adding after the row beginning 24-156 a civil penalty for violation of section 24-157, to read as follows:

§ 4. This local law takes effect immediately.
