THE COUNCIL OF THE CITY OF NEW YORK
RESOLUTION NO. 1049
Resolution approving the decision of the City Planning Commission on ULURP No. C 050098 MMM, an amendment to the City Map (L.U. No. 497).

WHEREAS, the City Planning Commission filed with the Council on May 26, 2005 its decision dated May 25, 2005 (the "Decision"), on the application submitted by Lincoln Center Development Project, Inc., pursuant to Sections 197-c and 199 of the New York City Charter and Section 5-430 et. seq.of the New York City Administrative Code, for a change in the City Map involving, the elimination, discontinuance and closing of portions of West 65th Street between Amsterdam Avenue and Broadway; the elimination, discontinuance and closing of public place within North Plaza; the elimination of a Pedestrian Overpass; the extinguishment of an easement; the adjustment of grades necessitated thereby; and any acquisition or disposition of real property related thereto, Community District 7, Borough of Manhattan, in accordance with Map No. 30215, dated December 10, 2004 and signed by the Borough President (ULURP No. C 050098 MMM) (the "Application");
WHEREAS, the Application is related to Applications Numbers N 050169 ZRM (L.U. No. 496), an amendment to the text of the Zoning Resolution; C 050170 GFM (L.U. No. 498), a revocable consent allowing the installation of information signage on a public sidewalk; and C 050219 PQM (L.U. No. 499), an acquisition of several easements;
WHEREAS, the Decision is subject to review and action by the Council pursuant to Section 197-d(b)(3) of the City Charter;
WHEREAS, upon due notice, the Council held a public hearing on the Decision and Application on June 15, 2005;
WHEREAS, the Council has considered the land use implications and other policy issues relating to the Decision and Application; and
WHEREAS, the Council has considered the relevant environmental issues and the Negative Declaration, issued on December 20, 2004 (CEQR No. 05DCP019M);

RESOLVED:
The Council finds the action described herein will have no significant effect on the environment.
Pursuant to Sections 197-d and 199 of the New York City Charter, the Council approves the Decision.
