A Local Law to amend the administrative code of the city of New York, in relation to requiring the review of certain parking signs and a utilization study of parking reserved for commercial vehicles
Be it enacted by the Council as follows:
Section 1. Subchapter 2 of chapter 1 of title 19 of the administrative code of the city of New York is amended by adding a new section 19-175.3 to read as follows:
§ 19-175.3 Review of parking signs and restrictions. a. Definitions. For purposes of this section, the terms “commercial parking meter area” and “truck loading zone” have the same meanings as set forth in section 19-170.1.
b. Parking signs in connection with certain facilities. No less than annually, the commissioner shall conduct a review to determine whether any parking sign should be updated, moved, or removed to account for closures or relocations of facilities, including but not limited to schools, hospitals, and government buildings, the presence of which was the basis for a parking restriction. The commissioner shall subsequently update, move, or remove any parking sign in accordance with the commissioner’s findings through such review.
c. Alternate side of the street parking signs. No less than annually, the commissioner shall consult with the commissioner of sanitation to identify any areas of the city where material changes in the frequency or timing of street cleaning have occurred. The commissioner shall assess alternate side of the street parking signs in such areas and shall update, move, or remove any such sign, as appropriate, in consultation with the commissioner of sanitation.
d. Commercial vehicle parking area utilization study and report. 1. No later than 5 years after the effective date of the local law that added this section, and at least every 5 years thereafter, the commissioner shall conduct a utilization study of commercial parking meter areas and truck loading zones. Through such study, the commissioner shall assess whether there are commercial parking meter areas and truck loading zones where the restriction to parking for commercial vehicles should be modified or removed due to low utilization of such areas and zones during the time periods that such restriction is in effect.
2. No later than 90 days after the completion of each study required under paragraph 1 of this subdivision, the commissioner shall submit to the mayor and the speaker of the council, and post on the department’s website, a report on such study. Such report shall include, but need not be limited to, the following information:
(a) The locations of the commercial parking meter areas and truck loading zones that were assessed through such study, including at a minimum a description of the relevant street segment or identification of the nearest intersections;
(b) Any specific actions taken by the commissioner based on the findings of the study;
(c) Any actions the commissioner is considering taking based on the findings of the study; and
(d) If the commissioner has determined to not take any actions based on the findings of the study, an explanation of the reasons for the determination.
§ 2. This local law takes effect immediately.
