A Local Law to amend the administrative code of the city of New York, in relation to the performance of fiscal agents

Be it enacted by the Council as follows:

Section 1. Chapter 4 of title 21 of the administrative code of the city of New York is amended by adding a new section 21-416 to read as follows:

§ 21-416 Fiscal agent reporting. a. Definitions. For purposes of this section, the following terms have the following meanings:

Community-based organization. The term “community-based organization” means a non-profit organization contracted by the department to provide services to, or operate for the benefit of, a particular community.

Fiscal agent. The term “fiscal agent” means an entity contracted by the department to perform financial administration tasks on behalf of a community-based organization, including receiving, holding, disbursing, processing, and recording funds or payments.

b. Report. The department shall submit an annual report to the council detailing:

1. The number of grants managed by each fiscal agent;

2. Average times for processing invoices and contract actions;

3. The number and nature of complaints received from community-based organizations regarding each fiscal agent, and the number of such complaints resolved; and

4. Performance metrics for evaluating fiscal agents including, but not limited to, timeliness standards for invoice processing and contract actions, responsiveness to community-based organization inquiries, and any additional indicators the department deems appropriate.

c. Feedback. The department shall establish a mechanism through which community-based organizations may submit feedback or grievances regarding the performance of any fiscal agent. Actions the department may take to address substantiated concerns may include, but not be limited to:

1. Requesting corrective action from the fiscal agent;

2. Increasing departmental monitoring or oversight;

3. Facilitating communication between the organization and the fiscal agent, requiring additional training for fiscal agent staff; or
