State Legislation Resolution No. 96
State Legislation Resolution requesting the New York State Legislature to pass bills introduced by Senator Padavan, S.6263, and Assembly Member Gianaris, A.9897, “AN ACT to enact the “wireless facility siting act”; to establish a one hundred twenty day moratorium upon the construction of wireless facilities in cities having a population of one million or more; to amend the general municipal law, in relation to the placement, construction and modification of wireless services facilities in certain municipalities; to direct the department of health to study, evaluate and make recommendations on the health effects of radio frequency signals and microwave energy emitted by wireless communications service facilities and wireless communications devices; and providing for the repeal of certain provisions upon expiration thereof”.

Whereas, bills have been introduced in the New York State Legislature by Senator Padavan, S.6263, and Assembly Member Gianaris, A.9897, “AN ACT to enact the “wireless facility siting act”; to establish a one hundred twenty day moratorium upon the construction of wireless facilities in cities having a population of one million or more; to amend the general municipal law, in relation to the placement, construction and modification of wireless services facilities in certain municipalities; to direct the department of health to study, evaluate and make recommendations on the health effects of radio frequency signals and microwave energy emitted by wireless communications service facilities and wireless communications devices; and providing for the repeal of certain provisions upon expiration thereof”; and
Whereas, the enactment of the above State Legislation requires the concurrence of the Council of the City of New York as the local legislative body; now, therefore, be it
Resolved, that the Council of the City of New York, in accordance with the provisions of Section 2 of Article 9 of the Constitution of the State of New York, does hereby request the New York State Legislature to enact into law the aforesaid pending bills.
