Summary: This bill would require the Commission on Civil and Human Rights (CCHR) to establish a hotline with telephone, text, and online capabilities for receiving reports from the public regarding incidents motivated by antisemitic, anti-Asian, and gender-based hate or bias, as well as other forms of hate and bias to be designated by the commission. CCHR would offer hotline users support and referrals as appropriate. CCHR would report the number and, to the extent practicable, severity of hate and bias incidents reported to the hotline, disaggregated by type of bias and by the police precinct where the incident occurred, in its annual report. These numbers would also be published quarterly and annually on CCHR’s website. CCHR would also describe how its outreach work is informed by hotline reports and make recommendations for preventing and addressing antisemitic, anti-Asian, gender-based, and other common or persistent types of hate- and bias-related harms.

A Local Law to amend the administrative code of the city of New York, in relation to establishing a hotline and detailed reports on antisemitism and other hate- and bias-related incidents

 

Be it enacted by the Council as follows:

 

Section 1. Chapter 1 of Title 8 of the administrative code of the city of New York is amended by adding a new section 8-135 to read as follows:

§ 8-135 Hate and bias reporting hotline. a. Hotline established. The commission shall establish a hotline with telephone, text and online capabilities for receiving incident information from the public regarding any conduct, speech or expression motivated, in whole or in part, by bias, prejudice, intolerance or bigotry. Such incident reports may include but shall not be limited to conduct, speech or expression constituting an unlawful discriminatory practice, discriminatory harassment or violence, or a violation of any section of this title or any other law. As appropriate, the commission shall provide hotline users with information, resources and referrals to city agencies or programs that provide assistance for individuals, organizations or communities affected by hate or bias.

b. Reporting requirements. Beginning in 2027, the commission shall report the following information as part of its annual report pursuant to subdivision i of section 905 of the charter:

1. how the public is informed of the availability of and how to access the hotline;

2. the number of distinct incidents reported to the hotline, disaggregated by:

(a) police precinct where each incident is alleged to have occurred;

(b) type of animus towards a targeted group that allegedly formed the motive for each incident, with respect to the following categories:

(1)   antisemitic

(2)   anti-asian;

(3) gender-based, as defined in section 8-102 and disaggregated into sex, sexual orientation, gender identity or expression, and other gender-related characteristic; and

(4) any other category of animus leading to high, persistent, or otherwise concerning rates of hate- and bias-related incidents, to be identified pursuant to rules promulgated by the commission.

3. To the extent practicable, a description of the severity of incidents reported, disaggregated by type of animus;

4. the number of persons for whom assistance was provided;

5. an explanation of how the commission’s outreach and education efforts are informed by hotline incident reports, including any efforts by the commission to improve reporting rates across all communities affected by hate or bias; and

6. proposals or recommendations for combatting bias, prejudice, intolerance and bigotry and preventing hate- and bias-related incidents in the city, including in relation to trends in reported hate- and bias-related incidents pursuant to subparagraph (b) of paragraph 2 of this subdivision.

c. Real-time tracking. The commission shall publish the data specified in paragraph 2 of subdivision b of this section quarterly and annually on its website. The first such quarterly report shall be posted no later than 30 days after the quarter ending on March 31, 2027, and the first such annual report shall be posted no later than 30 days after January 1, 2028.

§ 2. This local law takes effect July 1, 2026.
