Proposed Res. No. 288-A Title Resolution calling on the United States Congress to pass H.R. 260, which would close the background check loophole at gun shows by extending the Brady law to all sales at gun shows. Body By Council Members Yassky, Vallone Jr., Addabbo Jr., Clarke, DeBlasio, Felder, Fidler, Gerson, Katz, Koppell, Monserrate, Moskowitz, Nelson, Perkins, Recchia Jr., Rivera, Seabrook, Sears, Serrano, Gennaro, Brewer, Sanders, Boyland, Weprin and the Public Advocate (Ms. Gotbaum) Whereas, A majority of gun shows nationwide currently allow the anonymous buying and selling of firearms without conducting a background check and without the record keeping that would enable gun tracing; and Whereas, These nationwide gun shows are a significant source of guns and firearms for criminals who use them in the commission of crimes; and Whereas, The sales at these gun shows have an interstate effect because the firearms and ammunition sold at these guns shows move easily in and substantially affect interstate commerce; and Whereas, Due to the ease of interstate transfer of these firearms, even those States which have enacted proactive and strict gun laws find it increasingly difficult to reduce crimes and gun violence that are committed with firearms bought at gunshows; and Whereas, H.R. 260, also known as The Gun Show Background Check Act, will require the registration of gun show promoters and will set forth the responsibilities of promoters, licensees, and other transferors; and Whereas, H.R. 260 provides that if any part of a firearm transaction takes place at a gun show, each licensed importer, manufacturer, and dealer who transfers one or more firearms to a person who is not licensed shall, within ten days after the transfer, submit a report of the transfer to the Secretary of the Treasurer; and Whereas, H.R. 260 will extend Brady Law background checks to all firearms sales at gun shows, thus closing the gun show loophole; and Whereas, The closing of such loophole will have a significant impact on the protection of our communities and our young people; now, therefore, be it Resolved, That the Council of the City of New York calls on the United States Congress to pass H.R. 260, which would close the background check loophole at gun shows by extending the Brady law to all sales at gun shows.
