Summary: This bill would require agencies to train their employees, contractors, and subcontractors on the requirements of Administrative Code Section 10-178 and to publish protocols for implementing and complying with that law. The bill would apply the same training and protocol publication requirements to the Department of Correction, the Department of Probation, and the New York City Police Department regarding Administrative Code Sections 9-131, 9-205, and 14-154, respectively.

A Local Law to amend the administrative code of the city of New York, in relation to requiring agency training and the publication of implementation plans concerning immigration enforcement and cooperation with non-local law enforcement agencies

 

Be it enacted by the Council as follows:

 

Section 1. Section 9-131 of the administrative code of the city of New York, as added by local law number 62 for the year 2011 and amended by local law number 63 for the year 2026, is amended by adding new subdivisions i and j to read as follows:

i. No later than January 1, 2027, the commissioner shall develop a training for employees, contractors, and subcontractors on compliance with the requirements of this section. The commissioner shall ensure that each of its employees, contractors, and subcontractors completes such training at least once per year. An agency may provide such training in combination with other trainings provided to employees, contractors, and subcontractors.

j. No later than January 1, 2027, the commissioner shall publish implementation plans and compliance protocol detailing how the department will implement and how employees, contractors, and subcontractors will comply with the requirements of this section. The department shall publish on its website its policy regarding requests for information from federal immigration authorities.

§ 2. Section 9-205 of the administrative code of the city of New York, as added by local law number 226 for the year 2017, is amended by adding a new subdivision h to read as follows:

h. No later than January 1, 2027, the commissioner shall develop a training for employees, contractors, and subcontractors on compliance with the requirements of this section. The commissioner shall ensure that each of its employees, contractors, and subcontractors completes such training at least once per year. An agency may provide such training in combination with other trainings provided to employees, contractors, and subcontractors.

§ 3. Section 10-178 of the administrative code of the city of New York, as added by local law number 228 for the year 2017 and amended by local law number 63 for the year 2026, is amended by adding new subdivisions f and g to read as follows:

f. No later than January 1, 2027, the head of each agency shall develop a training for employees, contractors, and subcontractors on compliance with the requirements of this section. At a minimum, the training shall explain that employees, contractors, and subcontractors who receive a request from a non-local law enforcement agency that is related to immigration enforcement shall decline to honor such request without the approval of the agency head or general counsel or their designee. Each agency shall ensure that each of its employees, contractors, and subcontractors completes such training at least once per year. An agency may provide such training in combination with other trainings provided to employees, contractors, and subcontractors.

g. No later than January 1, 2027, the head of each agency shall publish implementation plans and compliance protocol detailing how the agency will implement and how employees, contractors, and subcontractors will comply with the requirements of this section.

§ 4. Section 14-154 of the administrative code of the city of New York, as added by local law number 21 for the year 2013 and amended by local law number 63 for the year 2026, is amended by adding new subdivisions h and i to read as follows:

h. No later than January 1, 2027, the commissioner shall develop a training for employees, contractors, and subcontractors on compliance with the requirements of this section. The commissioner shall ensure that each of its employees, contractors, and subcontractors completes such training at least once per year. An agency may provide such training in combination with other trainings provided to employees, contractors, and subcontractors.

i. No later than January 1, 2027, the commissioner shall publish implementation plans and compliance protocol detailing how the department will implement and how employees, contractors, and subcontractors will comply with the requirements of this section. The department shall publish on its website its policy regarding requests for information from federal immigration authorities.

§ 5. This local law takes effect immediately.
